Auto Insurance Claims: Not my fault in accident, insurance comapny, insurance details

QUESTION: Hi

In a mall there was lot of traffic and vehicle were moving at 5 miles. 1 lady hit my car while backing up in a parking lot. I called the cop and he filled the report.

However I made a mistake of not taking her insurance details. What should I do to claim damages from her insurance.

Please advice me

ANSWER: Hi Adarsh,

If the police made a report, the lady's insurance information will be on that report. You should contact the police department who wrote the report to find out how you can obtain a copy of the police report. Then you will have the insurance informaion and can call the insurance company to file a report.

The police did make the report and he has told me to come to police station on Tuesday.

Who decides if it is my mistake or other persons mistake and what should I do to get claims from her insurance.

Hi Adarsh,

The person at fault may be indicated in the police report. Sometimes the police officer is not able to determine fault so it may not be indicated.

To file the claim you will just have to find a local claims office of the insurance company of the other driver. Or if for example the insurance comapny is Allstate then call a local Allstate office and ask them for the phone number to report a claim.

The insurance company will take recorded statement from you and the other driver and they will determine who is at fault based on those statements.
