Auto Insurance Claims: not at fault but being blamed, small claims court, independent witness

Someone turned left in front of me in a parking lot yesterday and crashed into the right front corner of my car.  He admitted full blame and responsibility, gave me his actual insurance card, then left.  No police came to the scene.  I filed a claim with his insurance company, Geico, and also filed a police report.  Geico called me this morning to say the man said he was NOT at fault, and that I turned into him.  They said they don't have enough evidence to support my side of the story.  I have notified my own insurance company, State Farm, and they are going to try and get the money from Geico anyway.  If I end up having to pay for this, is there anything else I can do to save myself from this injustice?  Would I be able to take him or someone else from Geico to small claims court?  I believe that a judge- not someone from Geico, would be able to accept my side (the true side!) of the story.

Hi Brittany,

This is a classic he said - she said. Unless you have an independent witness it is unlikely you would win in court. You would need to have some kind of evidence to back up your story, not just your story. Just let the insurance companies handle it between themselves.

In the future ALWAYS call the police even if the incident is minor.
