Auto Insurance Claims: Auto Accident, party car, duty police

My 19 year old daughter, who is insured on my policy, was involved in an accident. She was in the middle lane of a three lane interstate highway. A semi truck and trailer cut in front of her from the right lane hitting the right rear of her car. She moved to the left as the truck hit her, hitting another car. She lost control and her car landed on it's side. She was unijured, but the car was totaled. The third party car hit the concrete median and the driver was injured. The truck left the scene, never stopping. An off duty police officer witnessed the accident and confirmed these facts. The third party has hired an attorney. What kind of ault is my daughter looking at?

If as you state you have a police officer who witnessed that the truck hit your daughter and forced her to the left, the your daughter is not at fault at all. You need to notify your insurance company of all of this information. They will provide your daughter with a defense attorney. Your daughters attorney needs to get a deposition of the police officer and if his statement checks out there should be no problem.
