Auto Insurance Claims: Claim Question, rental motorcycle, motorcycle trip

I was involved in a wreck on my motorcycle where the other party made an illegal turn and I hit them in the driver's door. I only obtained a bruise on my leg. They have admitted liability to repair my bike. The repairs will take 6 weeks, which will make me miss an annual motorcycle trip that I have had planned for 3 months, with a group of ten people. This is a State organization event that I have no control over rescheduling. I have hotel rooms, etc.

Is the Insurance company responsible to get me a "rental bike" while mine is being repaired? They offered a car, but that will not help, I have a car. They also said they could pay me for "loss of use" but again, that doesn't get me a motorcycle for the trip, let alone the other three weeks that I will be without.

What can I do?

THE OTHER EXPERT SAID THAT THE INSURANCE COMPANY IS LIABLE FOR A RENTAL MOTORCYCLE OR "LOSS OF USE". RENTAL MOTORCYCLES ARE HIGHER THAN VEHICLES TO RENT. IS THERE A STANDARD WAY TO CALCULATE LOSS OF USE?

Hi Barry,

Yes. The insurance company is responsible for paying for a comparable vehicle to one that was damaged. You should find a company that will rent you a motorcycle and get a written quote of the cost per day. You should then call the adjuster and tell them that you will need them to pay for the bike rental for your trip and that you will then be willing to switch to a rental car after you return from your trip. The insurance company will not be responsible for paying for any insurance on the rental bike only the daily rate plus tax. If they balk at that offer then tell then they can reimburse you for the entire cost of your trip as well as rent you a car for the duration of the repairs. If they say no to that then you will simply have to rent the bike yourself pay the cost and then file a law suit against the person who hit you. When you win in court it will be the insurance comapny that will have to write you the check.

Fight hard, stay tough, don't take no for an answer, elivate up the ladder.
