Auto Insurance Claims: shoulld I sue insurance company, allstate agent, car insurance company

Dear Mr. Richard Hixenbaugh:

   At Feb. 28, about 6 clock,one teenage girl hit my car in my driveway, her car is under her father's name, the car insurance company is Allstate. in March 5, Allstate agent checked my car and give me a estimate of $2718.18 damage. (the girls car has damage too, but my insurance is not involved, so I don't know what's her damage), in the beginning, Allstate off me 50%, I refused, then at July 2, All state give me a offer of 85%. the reason of 15% less is Allstate said the girl told him I made a Big wide turn before I enter my driveway. off course I refused it, since this is a nonsense reason.My street has one Lane in each side, there is at least 2 feet snow way in each side of the street, the street barely can allow one car pass through, Feb. 28, snowing every bad, 6 clock it's very dark. I drove about 5 miles/hour, before I enter my driveway. Now Allstate told me 85% is their final offer, I am very unhappy with It. should I sue Allstate and the girl? can I sure Allstate in where I am living?

Hi Richard,

You would not sue Allstate at all. If you file a law suit it would be against the girl who was driving and her father because he ownes the car and the insurance. If you file a law suit, you will have to pay court fees and it may be 5 or 6 months before you get a court date. But it is up to you.
