Auto Insurance Claims: Personal Injury Claim, seater sports car, abdominal cramps

Question
Hello,

I carpool with my cousin who drives a two-seater sports car.  We were rear-ended when we were at a complete stop - on my side.  I went to the doctor the same evening because my back was hurting and I also started having abdominal cramps (I'm 5 weeks pregnant)  I continued having abdominal cramps for days after and had to go to the emergency room yesterday because I also started bleeding.  The insurance adjuster wants me to make a recorded statement and will offer a settlement based on the statement.  I don't know what to do because if I settle, I could still possibly have a miscarriage AFTER the settlement.  The doctor also could not take x-rays because I am pregnant.  On top of that, I have no clue what amount would be sufficient to settle for.  HELP!!!

Answer
Hi Dawn,

I'm sorry your in this situation.

Do not settle this claim until after the birth of your baby. If all goes well and there are no issues with the birth related to the accident, then a generally rule of thumb for settlement of your injury is 3 to 5 times the total of all of your medical bills.

If there are any issues with the birth or if you are having ongoing issues your self, you should contact an attorney for assistance. Do not submit to a recorded statement until you have spoken with an attorney. The smallest mis-statement now could cost you a lot of money later.

Good luck with the baby.

I hope this helped
