Auto Insurance Claims: car accident, independent witness, conflict of interest

Question
A man crashed into the rear of my car in a MacDonalds drive through and he is saying that I reverse into him, my insurance company have advised me that as there are no witness or CT footage I have to accept 50% liability and have no choice in the matter the 3rd party is insured by the same company , i have fully comprehensive cover and 9 years no claims , please give your opinions, do you think there may be a conflict of interest as he is with the same insurers

Answer
Hi Wendy,

Unfortunately, when ther are conflicting stories and both parties are insured with the same company, it typacally results in a 50/50 liability decision. Without an independent witness there is no way to prove who is right.

I hope this helps
