Auto Insurance Claims: False auto claim filed against me, left turn signal, state insurance department

Question
What if i was riding behind a person in a parking lot Of The mall, and The person in front Of me must've saw a parking spot to The left Of him and put his left turn signal on but he didn't turn left,he just instantly stopped and i saw his back lights come on as if he wanted to back in instead of driving forward in, he started backing up so he could back in and i started to honk my horn consistently so he wouldn't back into me,but he didn't hear me honking and he backed into my jeep. I couldn't back up that fast because i was behind him and if i were to back up too i could've backed into someone if they were behind me. The first thing he said was that ''i'm so sorry,i didn't see u behind me''. I told him that i was honking but he didn't hear or see me behind him,he got a dent in The back Of his Car and my jeep had no damages, but when i told him i was gonna call The police to file a report,he claimed that he was an off duty police officer and told me not to worry and took his info and he took mines and we went our separate ways. Now 4 mths later my Insurance contacts me saying that the guy that backed into me made a claim with his insurance stating that i was in the wrong and now i have to Pay $250 for damages and my Insurance has increased By $70 From $120 to $190 a month. I'm asking you For Your advice on what should i do to get this false claim against me thrown out and my Insurance not to increase that much? I don't even know if this guy was even a real police and he lied about The accident!

Answer
You should explain to your claim rep what occurred and that you want them to deny his claim and defend you.  If the claim rep refuses, ask to speak to the supervisor.  If that does not work, file a complaint with the state insurance department.

Also, try to find out if he was a cop.  If so, file a complaint with his sergeant, accusing him of fraud.  Check with the mall security department to see if they had any security cameras in the area that might have captured the incident.

Unfortunately it is very common for people to lie about these types of claims.  It is difficult to prove a case without a witness.  Did anyone else see the accident or overhear the conversation?  Any other proof you can use?
