Can i sue the other persons insurance company, and person for my deductible?

Based on your question, I have to assume that you had your claim paid by your own insurance company who applied your deductible. When this happens, your insurance company will go after the other insurance company to get back their money as well as your deductible. Once they collect the money they will send you a check for your deductible.

You should contact your insurance company to see where they are in this process and when they expect to get th money back.
