Auto Insurance Claims: Do I have a case?, state insurance commissioners, insurance comapny

Recently, my son totaled my vehicle. He was not included or excluded on my insurance. I did not include him on my insurance because he was 18 when he got his driver's license. When he did get it, he moved in with his girlfriend. So, he was no longer living with me. He NEVER drove my car, except for that one night. I was very sick and needed some medicine. He was at my house because he did not want to leave me in the house alone and ill. So I asked him to go the store. The accident happened two blocks from the house. The insurance asked him to provide a bill for his new address but, he did not have one because everything was in his girlfriend's name. His license had my address on it because that was the only address he knew. Can the insurance company deny the claim?

The insurance comapny can deny the claim if your son lived in your house at the time of the accident. Your sone will need to assemble as much proof as possible that he lived somewhere else. He should have his girl friend as well as any other neighbors or friends to provide notorized letters stating that he has been living with his girl friend since what ever date they can think of. You would then submit these letter as proof. If the insurance comapny still denies the claim, you should file a formal complaint with your state insurance commissioners office.
