Auto Insurance Claims: Diminish value......, diminished value, bmw 325i

Hello Richard,
I was rear ended very badly on May' 08. I was driving a BMW 325i 2006 model. It went for a 12,000.00 repair for a month and was returned back to me. I also had to go to doctor for lot of time I still have pain in the shoulder. Firstly do i sound like a good candidate for diminished value for the car and should I get an attorney. Should I hire an attorney for the shoulder pain.
