Auto Insurance Claims: insurance theft claim, state insurance commissioners, fault claims

My car (2001 corvette)was stolen on 1-31-01, i have cooperated with my insurance company (phone interview, investigation, and EUO)throughout this ordeal; i completed my EUO in May-2008, i spoke with my adjuster on 6-23-08; he told me that the transcripts were being reviewed by his supervisor and that a final decision would be made by her soon.  My question is why are they dragging their feet with my claim? I was asked about my credit during the EUO, heck my credit has always range from bad to fair, it was like that when i purchase the insurance.  I have never filed a theft claim, don't have a history of submitting at fault claims, I have explain to the adjuster that this situation has cause me great grief and frustration (he told me he recommended the claim to the total off department (back in March-2008) only to have his supervisor retract it from that department (i had not been asked at that time to complete an EUO)  what gives?  in the state of TN is there a statue of some kind that prevents them from dragging their feet (i have cooperated with them according to their policy)?

Hi John,

Theft claims can be very frustrating. The insurance company always starts from the position that you had something to do with the theft. Then they work to try to exclude you as a suspect. In most states the insurance company 60 days to investigate and either pay or deny a theft claim. You should contact your state insurance commissioners office to see what the time limit is in your state. If they tell you it is 60 days then you should file a formal complaint against the insurance company.
