Auto Insurance Claims: parking lot accident in Texas, rental car company, parking lot accident

Question
My fiance backed into a sports car in a parking lot last month.  He looked through his mirrors and over both shoulders, but did not see the sports car past the bed of his truck.  The driver said he couldn't find the horn (he's in his 20's).  They agreed to attempt to work it out without insurance intervention, in addition the police never showed up at the scene.  The other driver finally got quotes to him last week. Now, the other driver wants to get his car fixed and is going out of town and wants my fiance's insurance to pay for the rental.  Is this valid?

Answer
Hi Barbara,

Since your fiancee was at fault he is responsible for all damages, costs and expenses related to the damage to the car. Those expenses include the actual cost of repairs as well as a rental car while the car is in the shop being repaired.

Your fiancee should verify that the sports car is actually in the shop being repaired. He should ask the shop how long it should take to complete the repairs. Then he should pay for that number of days. The cost of the rental car should not exceed $30.00 per day. Your fiancee is not responsible for paying for any extra insurance offered by the rental car company. The sports car owners insurance will extend to the rental car.

I hope this helps
