Auto Insurance Claims: hit by boat trailer, witness fee, word case

My car was hit by a boat trailer on 6/14/08 in AZ. My car was parked w/ left rear door open while my friend was getting stuff at the back seat. He drove his friend's truck towing an unloaded boat trailer. The truck passed by, but the trailer squeezed the edge of my door. He apologized and gave me his insurance at scene. There's no police report. 1 week later he changed his story saying my friend opened the door after the truck drove by, so it's not his fault. His insurance deny the claim based on his statement. I have pic. showing the trailer crossed the line to my parking space, and it's impossible for my friend to open the door within 1 sec. w/out being hit by the trailer first. My insurance won't help me due to it's word vs. word case. They told me to file small claim. How much chance I can win to file the small claim and how much can I claim for? Besides the car damage, can I claim car rental, witness fee(my friend), and travelling to court cost? He lives about 60 miles away and the accident happened in AZ. Thank you!

Hi Yun,

You will have to go to court ant tell your story. Show your pictures and have your friend testify. You can sue for all expenses caused by the accident. How much you will receive will depend on Judge and if he thinks you are telling the truth more than the other guy.
