I am a care giver to an elderly woman who needs to be driven around. Got into a car accident as a passenger and the butler who was driving the vehicle I was has a suspended drivers license. We were hit by an intoxicated driver who attempted to flee but stalled out and we were able get the police there quickly. The driver of the vehicle that hit us was taken to jail. We received the police report today and it had me listed as the driver of our the car instead of the butler. I called gieco and they said they are refusing to process the claim until the butler calls to verify this information. My question is if the butler does call to correct the report can the insurance of the at-fault driver refuse to pay for damages?

The fact that the butler had a suspended license has no bearing on your ability to collect for injuries or the car's owner to collect for damages since the other party was at fault.
Have the butler call the police and make a correction on the accident report and then have him call Geico.
