Auto Insurance Claims: FLORIDA DIMINISHED VALUE, diminished value, auto claims

Hi Richard, I ve been looking around and preparing my self to go against an insurance corporate to claim DV in my vehicle. since it was a third party, I already send them over plenty of proof about DV, they denied payment, for now, however I ask them to put that in writing and the policy language, they said there is no cases of DV in Florida and they have no policy language on DV, and that vehicles depreciate every day so that mine has no DV. Is that true?  I dont know that for sure, but what I know is that since they are supposed to put my car back to true PRE accident condition, including function, appearance, safety and VALUE, they are liable for this. I know also that Florida tort law covers me in this aspect of DV, but is this vs. Insurer or insured?
The at fault party is being charged by the state of Florida and she is awaiting trial, the state attorney sent me a letter stating that whatever the insurer does not pay I can collect from her; should I use this also to persuade the insurer??
I would appreciate if you could advice me what to do if they stick to their decision.

Hi Ivan,

Insurance companies will often try to deny dimisinished value claims in hopes that you will just go away. You need the right documentation and the ability to answer their objections.

You will need to hire a professional diminisihed value appraiser to inspect your vehicle and write an appraisal report that will determine the amount of diminished value. This appraiser should also be able to provide you with instruction on the process.

You can submit your appraisal report to the state attorney to be included in the case. If the judge includes it in the restitution order, then the insurance company will have to pay. The insurance policy pay for all damages that the at-fault party is legally liable for. If the judge says she is legally liable than they will have to pay.
