Auto Insurance Claims: Car accident, side fender, san francisco bay area

I was involved in an accident. I was driving on the main road with the right of way. I may or may not have been speeding a little. A semi-truck is waiting to turn left off of the main road to a side street. A vehicle who wants to make a left turn onto the main road jumps out into my way and slams on his breaks. I'm around 30 to 40 feet away. I slam on my breaks, and skid right into him. My front passenger hit his front drivers side fender. With his failure to yield to me and the trucker, he would be at fault whether or not I was speeding?

If you admit to speeding, then a small percentage (10%-20%) of the fault will be assigned to you on the theory that you could have stopped if you had not been speeding.
