Auto Insurance Claims: how much should I negotiate for my auto accident, property casualty insurance, casualty insurance industry

Question
I was in an accident last November where the other driver was totally at fault He was given a ticket making an illigal turn . Making a left turn into my drivers side and pushing me off the road into a brick wall. My car was a total loss and I have since had medical bills totalling $12473.00. (these include doctors, Physical therapist, MRI, CAT scan, medical co-pays and prescriptions). Had some temporary problems with my right eye and some powder burn marks on my face ( now fading)

My eye is getting better, but my bruised chest still has discolorations, and my right shoulder after three months of physical therapy still hurts, and I sometimes still wake up stiff. Still on medication but now only use it at night. I have lost wages totalling $3456.00 from a week and a half of no work, and times used for doctors , PT etc appointments. Where should I start my negotiations, what is a reasonable/realistic settlement amount? Accident was in Wisconsin.

Answer
Hi Tessa,
I am not an attorney and can not make any statements that could be considered as giving you free legal advise.
However, I can give you my opinions and observations based on 44 years of experience in the Property & Casualty Insurance industry and dealings with my own clients with similar injuries.
It appears that you are still treating for your injuries, therefore, you are not 100% recovered and not ready to make a demand for settlement.
I suggest that you continue you Physical Therapy treatment until you are 100% recovered and will then know if your injuries are going to cause any permanent disability or change in lifestyle.
I am assuming that the powder burns were caused by the explosion of the air bag.  You need to wait until that clears up or a determination is made for plastic surgery.
Once you have fully recovered, please write me a PRIVATE follow up with more specific details about your injuries and any disability or
plastic surgery for your face and update you dollar expenses.

I hope this information is of help.
Your feedback by rating my answer will be appreciated.
Sincerely,
Bennie
