Auto Insurance Claims: accident on freeway, lane freeway, maughan

i drive a box(18')truck.changing from no.2 to no.3 lane on a 4 lane freeway.i signaled&checked right mirror.no vehicle in no.3.only an suv in no.2 lane coming up fast.as i change from no.2 to no.3 suv also changes from no.2 to 3&tries to speed past me.after we collide suv still goes same speed til he sees me trying to catch up.no damage to my truck.long scratches on suvs' driver side rear panel.who's fault?

It's really hard to say with the limited info here.  It really depends on who was in the lane the longest and who changed lanes into who.  The adjuster will take statements from both of you and look at both vehicles and then make a decision.
