Auto Insurance Claims: 3rd Party Insurance Claim - Automobile, texas department of insurance, einsurance

Recently my daughter was in a car wreck and the other party was responsible.  EInsurance is the other party's insurance carrier and they have totaled her car.  They are trying to low ball us on the value of her vehicle and have refused to discuss/negiotate the claim.  What are my rights - we only had liability on her vehicle.  We are in Texas.

Hi Darla,

You should demand that they provide you with the documentation that they used to determine the value of your car. Then you can check it for errors.

You should also go to www.autotrader.com to l;ook for vehicles like your that are currently for sale with in a 75 mile radius of your zip code. Print out and average what you find. If the values you find justify a higher value, you should send it to the insurance company to negotiate. If they refuse to negotiate, you can file a complaint With the Texas Department of Insurance.
