Auto Insurance Claims: settlement, binding document, surger

I guess I at this point I consider myself ignorant. Especially after finding out that many years ago my husband decided to settle on an accident involving a rear end collission. There was a lot going on at that time between my husband and i and I recall NOT questioning him. In fact I feel at fault, also. My question is: He (we) settle for a small amount and the accident was major.
My daughter was in a rear end accident just recently and I am now beginning to question why he settled after talking to her. Two years later I had to have neck surgery. The surgeon asked if i was in a wreck and even though the Insurance paid most of it, the surger was quite expensive that i am still paying for it. I guess there is no way that i could go back and re open the claim. NORTH CAROLINA.

Hi Manuela,

Unfortunately, when you reach a settlement they require you to sign a release form that says that no matter what you will never come back to them to reopen the claim. This is a legally binding document that forever closes the claim.

Just be sure your daughter does not make the same mistake if she was injured.
