Auto Insurance Claims: Accident claim, time trouble, accident claim

My wife was involved in a accident that was not her fault.  Our mini van was damaged.  The at fault's parties insurance company considers the vehicle "totaled" because repairs exceed it's current value.  I am being told that if I want my car back, I will have to pay the difference which could as much as $2000.

I have done nothing wrong, and I just want our car back, is it true I will personally have out of pocket expenses ?

Hi Dan,

The insurance company is required to pay you for the cost of repairs or the value of the vehicle, which ever is less. You should not keep the vehicle. Take the money and use it to purchase another car. The time trouble and expense is just not worth it.
