Auto Insurance Claims: Diminished Value claims in Ohio, diminished value claims, independent vehicle


Question
QUESTION: I got rear-ended and it is 100% the other party's fault (confirmed by police report).  I had a 2007 Toyota Sienna w/6500 miles.  The repair estimate is $12,000.00  
How can I process Dimished value claims in Ohio against Liberty Mutual (the fault party insurance company)

When you are not at fault, you are entitled to collect diminished value in all 50 states.  However it is your responsibility to prove your loss. This is done by hiring a professional independent vehicle appraiser who specializes in determining diminished value. There is recent case law in Ohio that supports your right to be paid for diminished value.

Like once I got the independent vehicle appraiser report, what else to I need to do beside submitted it to the insurance?

Hi Tim,

The appraiser you hire should be able to provide you will all necessary instruction, forms and ongoing assistance to help you reach a reasonable settlement.

Once you submit your report the insurance company will then respond to you. There will be several sets of back and forth negotiations that should take place only in writing. If the insurance company does not properly negotiate with you, then you would file a law suit against the at-fault party. Upon a successful finding in court, it would be the insurance company that would write you the check. However, generally less than 1% of these claims end up in court.
