Auto Insurance Claims: What are they responsible for??, auto body shop, insurance company claims

Question
Hi! I recently got into an accident with a woman who was driving her friends car. She was not on the policy and do not know if she was actually being covered but Travelers Insurance did cover the claim. I live in Illinois. The woman hit my front driver side tire which then had to be replaced. The tires had roughly 18,000 miles on them already. The treads were at 6/32. The new tires is at 11/32. Due to only the driver side being replaced, the car pulls to the right. The auto body shop said that the only way to fix the problem was to get a new tire on the right side because the 2 tires are uneven and that is what is causing the pulling (The pulling that was not there before the accident). The insurance company claims that they are only responsible for giving me half a tire because my tire I lost was half worn and they are giving me more than I lost. They say that once I buy a new tire for the passenger side, the problem will be fixed. He said this is STANDARD of insurance companies to oonly repace what is broken. The problem is obviously not fixed because they are not giving me a new 2nd tire. Wouldnt this be considered not fixed? Would they be responsibile for buying a new tire? The problem wouldnt exist if they gave me all the proper parts to fix it (a second new tire). Who is responsible for the pulling?

Answer
Hi Heather,

Insurance companies have no interest in paying you what you are entitled to. They just pay what they can get away with and steal the rest.

You are correct. Especially with tires they should replace both. However, since they would actually be making you better due to the additional tread, they would be able to make you responsible for up to 70 percent of the cost of the other tire. So if it is a $100.00 tire they would only pay $30.00 and you would pay the other $70.00.  They basically just say no because they know that you will not likely fight very hard over $30.00.

I hope this helps
