Auto Insurance Claims: Accident in parking garage, worth a shot, parking garage

Hello - I was recently in an accident in a parking garage.  I was driving up the ramp to park, while the other car was driving down.  The other vehicle drove around the corner without paying attention (was talking to a passenger) and struck my car on the driver's side, right behind the wheel well.  This ended up bending a pin holding my tire on, necessitating a tow and repairs.  There were no markings on the ramp, and perhaps I was a little over the imaginary central line, however not by much, if at all.  The other driver admitted that she hadn't seen me, and said "maybe you're a little too far to the left".  Since then, she has denied liability and blamed me. My company has determined she was at fault, and my rates are not affected.  The other driver has not made a property claim, and in fact told her company and my company that she had sold the car over the weekend (accident happened Friday morning).  My company is now subrogating her company for their costs (approximately $900 for fixing and rental car) and my deductible ($1,000).  How long is this likely to take, and what are my odds of getting my deductible back?

It's worth a shot. Unfortunately, the likely scenario is that the other insurance company will ask their driver for her version of events. If she denys she was at fault, they will likely take her side and deny your claim. Then you have a classic she said, she said situation. Then the claim will (in 6 to 8 months) be sent to arbitration where they will likely decide on a 50/50 liability decision. In which case you may get back 50% of your loss.

In other words, hope for the best, but don't plan you life around getting the money back.
