Auto Insurance Claims: Parked car hit parked car., wi circuit court, drug convictions

Question
In Feb 2011 my vehicle was parked on the side of the street outside of my home.  I was inside my home when an individual smashed into the rear of my vehicle pushing it over 5 feet into the rear of another vehicle.  My vehicle was totaled.  The driver of the vehicle that caused the accident had no license, insurance and was not the owner of the vehicle she was driving.  The individual was also likely under the influence of narcotics, though she was never tested ( to my surprised with over 4 prior felony drug convictions per the WI circuit court).

As you can imagine, this spectacular human being has been "unreachable" since the accident.  Now the insurance company of the parked vehicle that my parked car was pushed into is harassing me consistently seeking compensation.  Do they have a leg to stand on here?  And if so, wow.

Answer
Hi Matt,

Absolutely not.

If it is documented that there wqs another responsible person for the damage and that your vehicle was parked and unoccupied and that this other person hit your car and pushed it into the third car, there is no way any day that you have any responsibility.

You should tell these people to obtain a copy of the police report. Remind them that you were not driving and that your car was parked. You were not negligent in any way and will not give them a cent. You should also tell them that if they contact you again in any manner, that you will file suit against them for harrassment. If you want to, you can also just refer them to your insurance company. If you do so be sure to call your insurance company and tell them to put big notes in your claim file that they are not to pay anything on any claims presented.

I hope this helps
