Auto Insurance Claims: According to police report, were both at fault., monte carlo ss, rear quarter panel


Question
I was involved in an accident with an AT&T utility truck (that is self insured).  The truck was parked on the right side of the street.  I drove from behind the truck around the truck to turn right on the street in front of the truck.  When I made the turn the truck pulled forward and struck my rear quarter panel of my mint condition 71 Chevy Monte Carlo SS.  I have two notarized statements from witnesses stating the truck was parked.  There was one witness that said I cut the truck off (the driver claims he was waiting for pedestrians to cross while he was waiting at a red light).  AT&T told me to fix my car (extensive damages) and they would fix their truck (scratch on the bumper) considering both drivers had contributing factors based on the police report (mine were failed to yield and distracted??).  His was Driverless vehicle?  The police officer won't return my calls to have the report amended.  No lawyer will take my case since the police report says we both had contributing factors.  Is there anything I can do to get AT&T to accept my claim?

Hi Paul,

Unfortunately this is a classic he said - he said situation. About the only thing you could do would be to file a small claims law suit against the driver and at&t. You will need to subpeona your witnesses to testify. Then if the judge believes your story more than the other drivers, you may win your case and they will have to pay.

Also, If you have collision coverage, you can make a claim on your policy and they will fight it out with at&t to get reimbursed (if they feel you were not at fault).
