Auto Insurance Claims: My insurance company created a claim that I dont need or want., rental car company, insurance company

In February I was rear-ended while waiting at a stop light.  A police officer witnessed the whole event and there was no question that the other guy was at fault. I made a claim with his insurance company and got an estimate to fix my car. However, the driver was in a rental car and his insurance company gave my claim to the rental car company. This whole process took about 2 months. The rental car company agreed to pay the damages. Last week I got a letter from my insurance company saying that they learned about the accident, created a claim for me, and are now investigating it. They won't drop the claim. I don't want a claim and I don't want this to show up on my record. I was wondering if I have any rights in a case like this. I would appriciate some advice.

Hi Heather,

You should call your insurance company and ask to speak to a supervisor. Tell the super that the other party was at fault and that their rental company has already accepted liability and has or is going to pay for the damage. Instruct them that there is nothing for them to investigate and demand that they close their file and do no further work on the claim.  If the supervisor gives you a hard time, then ask to speek to his boss and so on.  There is no reason for them to expend resources on a claim that is already settled.
