Auto Insurance Claims: Shifty Cab Driver, lincoln town car, gypsy cab

Hi, I was involved in an accident while exiting a gas station.  My car was stopped, while waiting to enter a busy highway I was rear-ended by the driver of a Lincoln town car 'gypsy cab'.  Even though it happened within the confines of the gas station parking lot, my car managed to sustain significant damage, as the driver (admittedly) was on the phone at the time and did not see me.  The accident was clearly his fault, but somehow the driver convinced me not to notify the police and gave me his general information, (address, lic. plate #, cell phone #).  Low and behold the man has been dodging me ever since, but when I confront him on his cell phone he admits full responsibility and tells me he'll call etc.  The accident happened last September in New Jersey and I have a witness that was in the car with me.  I had an estimate done around the time of the accident that came out to over three thousand dollars. What should I do to get this problem solved?  Thank you kindly for your help, -Joseph

You can either file a claim under your own policy and then let them pursue this individual for their money and your deductible  or  you will have to take him to court.

I would also go ahead and file a police report so his tag will be documented.  If he had no insurance, you may be able to file under uninsured motorist.  I have no idea what the level of cooperation is with New Jersey police agencies.
