Auto Insurance Claims: Under insured claim, minor aggravation, lower back injury

Question:   Hi
I was in a wreck with an underinsured driver, I settled with the at fault drivers insurance for their policy limits of $30,000.00.  My medical bills were $31,000.00.

The following are the injuries sustained from the accident.
 Aggravated pre-existing  lower back injury
 whiplash
 shoulder impingement
 frozen shoulder

After I received the settlement from the at fault driver I then filed a claim with my insurance carrier. They sent my medical records to an Independent Doctor to review . Their doctor feels that I only sustained miner injury to my neck and minor aggravation to lower back. He states that the shoulder injury has nothing to do with the accident that it is just from normal were and tear.

My insurance compay said my whole clain was worth $35,000.00 and since I received $30,000.00 from the at fault company they would give me $5,000.00.  I have never had any problems with my shoulders. How do I go about disputing their doctors to prove that the shoulder injury was caused by the accident?

Answer
If your medical bills were 31,000 and they only paid you 35K, you were were way underpaid if all the injuries were from the accident. In any case, you need a lawyer. Get one who will not take his fee from money you already got on your own. His fees must come from any new money he gets for you.
