Auto Insurance Claims: insurance with DWI, Work Vehicle DWI

Question
My husband has a pending DWI that he received while driving his company truck. If charged will this affect our personal car insurance cost although my car and our daughter's are both in my name in the state of Texas?

Answer
Whether your husband was in a work vehicle or not is irrelevant.  Driving histories are tied to driver licenses, not vehicles.  A DWI conviction will definitely affect your insurance, but it is hard to say how it will affect it without knowing the final disposition of the DWI case, and the specific insurance company's underwriting guidelines.

1. Worst case scenario, your husband is convicted, has to get an SR22 and your rates go up for the next three to five years.

2.  Best case scenario, your husband is not convicted of DWI.

In between scenario, your husband is convicted, but an SR22 isn't required and your insurance company doesn't check his driving history for another 3 years, so no issues with insurance for a while.

Any of those scenarios could be true depending on your specific case.  This answer is not intended to be legal advice.  I strongly urge you to contact an attorney to discuss your legal options and for specific legal questions.

I hope this helps!
