Land Rover Repair: Discovery 2003 Oil Starvation, land rover service, oil starvation

Question
John,
Thanks so much for your posting of Land Rover's March 14, 2003 Technical Alert to its dealers with a misalignment in the pins that located the oil pump in the front of the motor.

I am one of the owners of such a vehicle that I bought less than 30 days ago as "Certified". The service department seemed to know right away what the issue was, however they claim APCO will not pay the claim to replace the Engine,APCO tells me that the dealership will not tear down the engine to show the cause and therefore they will not cover this unless they are shown the reason for the oil starvation.

My question here is, what is the magic formula to  make this claim go though? The Dealer has advised me to simply drive the vehicle untill it gets worse. I do not like that idea at all. Furthermore  APCO has the claim listed as replacement of Short block, I am having lifter noise and I am afraid that even when the issue of oil starvation is resolved the lifters will still have had damage done. (assuming they are going to re use these)Wouldnt a long block be a better way to go ?
Thanks in advance for your advice
Robert
