Towing Issues: Drive line disconection/ abandoned vehical, sheer laziness, towing association

Question
Recently my R.V. was towed because they thought I had abandoned it.  When they towed it they did not undo the drive line and left it in gear.  Now that I have paid upward to $1,300 do various people to get my R.V. back the transmission is just totally shot.  It's been reduced to grinding metal.  When I spoke to the manager on the phone he said that the problem is that since it was marked as "junk" or "abandoned" by the police they aren't required to unhook the drive line, from what he said they don't even have to take it out of gear or take the emergency brake off!!  You think it would be easier on their trucks! Do I have a case?  It was justifiably towed as an abandoned vehicle although when they marked the tires with spray paint I did move it a few feet to let them know it wasn't abandoned, but aside from that it was unregistered.  There's no doubt in my mind, legally it should have been towed, but I am concerned in the manner it was towed.  What if people want there vehicles back?!? Should they be held liable?

Answer
Ask any professional certified tower and the answer is, (regardless of condition) the driveline should have been disconnected if towed on the drive wheels, PERIOD. As the tow form being marked junk or abandoned, that is someone's opinion and obviously it's not since you reclaimed the vehicle. Personally, extra care and handling should have been exercised since the towers didn't know the operational condition of the vehicle. What many inexperienced or novice towers don't understand is it's not just transmission damage that could occur or result. I could go into detail about I'll stay focused on your situation. My opinion is, I am sorry to hear that you were a victim of sheer laziness and lack of experience. I would contact your local or state towing association for the proper laws and procedures for what options you could have. Best of luck.
