Towing Issues: Illegally parked cars, midwood brooklyn, block park

My brother has a private house with a party driveway in Midwood Brooklyn.  The owners of a business on the block park their cars either blocking his driveway and they also pull up into the driveway.  They have been spoken to at least 10 times and told they have no permission to park there but continue to do so.  Today I called the police to ticket the car blocking the driveway and then called to have it towed but they moved it before it was towed,  An hour later they parked another car up in the driveway but were blocking the sidewalk as well.and stayed about 2 hours but moved before the cops came to ticket it.  What
recourse do I have to stop them from parking her. They actually told me and the police that my brother doesn't have a car so they should be able to park there and were outraged that I called to have them ticketed. I can't believe they then parked in the driveway.  Please advise me on what to do?  Thank you.

Not sure what to do on this one,  shared driveways are big legal problems.

But if the business does not "legally share" the driveway then you are in your rights to have then either ticketed or towed (which can be tricky to do since its shared)

But even if your brother does not have a car then its still property he controls and the business is "trespassing" at that point if they have not legal rights to use the property.

But I also know the police will say it is a civil matter and such not do a lot about it...  
It is one of those issues which is hard to deal with even in courts...

Have you talked to a lawyer about this and see what he suggests be done in this case... That might be the best thing as it will end up in court if any vehicles are towed and that creates more problems.


Sorry but that is about the best advise I have, other than to say have your brother get a vehicle and park it in his space so they can not say he does not drive and need the space.
