Towing Issues: what to do?, store supervisor, tow company

Question
I am a self employed truck driver on thursday evening the 19th of June 2008, i parked my reefer by friday morning it had been towed away . I called the towing company and asked them the reason for picking up the trailer, I was told they had been called by the store which is a truck stop...I took it upon myself and went to stipes and asked if the had called the towing company...I was told by the store supervisor they do not call anyone unless the trailer has been there for sevral weeks, and if when they do call someone it would be the police departmen not the towing company... they're having alot of problems with this towing company...It seems that they driving around and checking for trailers that are unattended without being called... the store supervisor was offered money if he would call and let them know when trailer was unattended..IS WHAT THIS COMPANY DOING LEGAL???

Answer
Well it does not sound legal to me what is happening...

It kind of sounds like the tow company is "patrolling the lot" looking for vehicles to tow.  Now if the tow company does not have a written contract then it is most definitely illegal in most states (that part is left out of the question so I can not tell you specific answers)

But it really sounds like Grand Theft Auto is a very  good possibility in this case. Have you talked to the local police about it ?

If this is a "problem company" then they most likely will know about it and have other reports like this.

This really sounds like a court case to me against the tow company...
