Towing Issues: resident being towed, wet sidewalk, tow company

I manage an apartment communty, the company I use for towing should only tow when I request it. they came in one night and towed a vehicle for being in a construction zone without my prior approval. Not only did they tow but the resident said they damaged her vehicle.The so called constuction site were cones in place to keep people from walking on a wet sidewalk. None the less i spoke with the owner and wanted to see the pics he took and he promised to give her money back. Now he is avoiding my calls and will not return my messages. what is my recourse of action?

Well, since I do not know what state you are in, I can not tell you if they broke any laws, but it sounds as if they might of broke some laws...

Generally the tow company is under contract to provide towing services, and you should have a copy of the contract... It will spell out what is allowed or not..

But I wonder why she was parked where they were trying to keep people from walking on a wet sidewalk (am guessing new concrete)

Your recourses, well first of all if they are playing games and not talking to you, the property manager, then CANCEL THE CONTRACT....


Find another tow company and make sure there are no provisions for "patrol or roam towing" in there... It might be a big problem for you to get up when there are vehicles to be towed, but you would be ordering the tows and signing the authorizations for each one...

By the way, pictures of each violation are great to have, as they hold up in court as to the "legality of the tow reason"
