Towing Issues: Towing Signage Requirements, colorado puc, property management company

My wife parked in a private office building parking lot and ended up getting towed. The "No Parking" signs (2) that were nearest her parking lot were damaged previously and were laying face down. In her rush to catch her train she did not notice either sign and came back to find an empty parking spot and the signs standing back upright. Are there any regulations regarding the maintenance of No Parking signs? Do I have any opportunity to recover the $160 towing fee from the property management company? Where can I find a resource to review the parking regulations in Colorado? The car was towed from a lot in the Denver area. Any assistance/information you can provide will be greatly appreciated. I also have pictures of how the signs were laying when she parked.

Well, I know the Colorado PUC department does regulate towing services and operations to an extent. Also Denver has regulations regarding towing vehicles from private parking lots...

BUT that state is also the hardest to find rules and regulations online from.. I have tried before and tried again for you...  

But as a general answer I will say this,  the tow signs do get vandalized and are subject to weather issues... Now it sounds as if the lot your wife parked in had an existing contract with a tow company and even though the signs were there they were not in good shape or posted legal at that point...

BUT things to happen to the signs and while they might of been replaced or put back up after your wife's car was towed does not mean it was illegally towed...  After all who is to say that a "disgruntled customer" had not been towed 2 hours before your wife...
But on the other side, who is to say that the property management and tow company could not or did not maintain the signs properly...

All of that would be based on what a judge would rule if taken to court.


The fee, well you could try going the small claims court route and see what the judge would say. I doubt the property management firm or the property owner would refund you the money. And of course the tow company was only doing what they are called to do.
$ 160.00 is actually kind of low for what I hear for towing rates in the Denver area and other areas.
