Towing Issues: towed from private property, small claims court, tow company


Question
I have a friend who was renting a room in a house with a so called friend. The car had Missouri tags that were expired. She ended up in a shelter, leaving her Jeep in the driveway. When we went to get it and some of her things, the landlord called the police and told her she was driving it off. Realizing that she would get in trouble we talked her into leaving it behind till we could get it. Her rent was paid up  at the time, so she still had tenants rights. The next day, she called a tow company had had them tow it. I checked with the police, and they did not authorize the tow. The landlord has since moved. Can we sue the tow company?

Why is it everyone wants to sue the tow company for doing a job that the property owners/ managers authorize...

It amazes me each time I get that in a question...
You do not sue the fire department because you had a fire, or sue the police because you are a victim of a crime..

The proper person to go after would be the landlord or friend as one of them had to authorize the tow.. From your question, the landlord would be the proper one to go after...  Tenants right are different in each state and as such I would suggest that you check out the specific laws in your state ( I can not help much as I do not know which of the 50 you live in)

Small Claims court allows you to sue anyone you want, but remember if you go after the wrong party you can also lose and be responsible for legal fees from the other party...  "Check carefully into who ordered the tow", and then try to find the party, that is who I would be going after..
