Towing Issues: One Bad Morning, tow truck company, small claims court

Question
I live in Houston Texas and i spent the night at a friends apartment and i parked my car in one of the spots that anyone could park in. The complex allows for visitors to park in any non-coverd spots. I woke up the next morning only to find that my car had been towed away. Is there anything i can do to get my money back or even sue the tow truck company who did this? How am i suppose to go to school or go to work today? I did not park in a spot that was illegal nor did i park incorectly.

Answer
While I can not specifically tell you if the tow was legal or not, you always have the rights to sue the complex management, after all they are the ones who "should of signed the authorization to tow" ...

As it if the tow was legal it also depends on signs stating what the parking regulations are, or if certain spaces are reserved or not... Again I was not there so I can not really answer it specifically...

The tow company generally (ok there are some bad apples in every business) are just responding to the request to remove the vehicle by order of someone...

Best case is find out who authorized the tow, and start there. Find out the real reason the vehicle was towed...

Small claims court is set up so you can go after (sue) anyone you feel is doing you wrong. Be it the tow company, the apartment complex management/owners, your friend for telling you to park in the wrong space or what ever... But unfortunately you as a motorist have expenses which happen from time to time either as needed expenses or unexpected expenses (breakdowns, maintenance, or towing)

As to getting to school or work, I am sorry but I can not answer that but I hope you got the vehicle out by paying the towing fees owed...
