Towing Issues: mistakenly towed, tow company, business establishment

Recently my car was mistakenly towed from the premesis of a business establishment and I believe it was the fault of the business that I was visiting.  I will take it up with the business to get reimbursed for the tow charges; however this could take some time and I don't want to be out of pocket for the money for that long.  Depending on the cooperation I get, I may never see this money again.  I paid for the charges on my credit card and I am wondering if I should contest the charges with the credit card company so that I won't have to pay them.  What possible legal action could the tow company take if I do this?  Do they have any rights against me?

while I am not a lawyer or your credit card company, I would like to point out one thing here.

If you dispute the credit card charge it then becomes a basically "theft of services" charge for the tow company to file. After all they did provide a service for the property owner by responding to the request to remove your vehicle.

Now lets say you dispute the charges on your credit card, and the credit card company removes them from your bill (not that it happens all the time as they understand the towing charges), and you talk to the business and get the money reimbursed which was put on the credit card..

What are you out at this point?
Can you "HONESTLY SAY" that you would go to the tow company and repay them the fees for the service rendered ???

Or would you decide to keep all the money and let the tow company not get paid for the services they provided. Remember that by paying with a credit card (just picking numbers here for this example) an amount of $100.00 means that the tow company also has to pay a fee for accepting your credit card of say 3%... That means that they paid the credit card company $3.00 to accept your credit card so that you could use it.

Now if the tow company decides that you disputed the charges and they want to get paid (remember I am not a lawyer) they could file in Small Claims Court for up to 3 times the charges (varies by state the amount) that were the original charges owed.
Plus in some states they can file police reports, and notify the DMW and have you arrested or your drivers license or vehicle registration suspended for non payment.

You said you where "mistakenly towed" from a business. Now why would you believe that, where you parked in the lot and only visited that business, or did you walk next door to the restaurant or bar?

Were you parked in an authorized parking space, not blocking anyone in, or blocking a fire lane. These bits of information which are lacking in your question prevent answering questions with a better degree of being correct for what ever city - state (you did not mention this key piece of information) you are in..


But in a nut shell, this question is one where it is hard to provide a correct answer as it depends on the business you are trying to get the money back from, and the credit card companies answers to the dispute...

Nice to see that even though I asked for more specific information such as the State or City, and what kind of reason it was mistakenly towed from the business, I guess I deserve the slam and feedback for not being a mind reader and able to provide a correct answer in your mind.

Yes I tried to answer the question which I read as what can the tow company do if you dispute (stop payment) on the credit card.

Your credit card company will advise you if they will allow you to stop payment or dispute the charges. They will also provide you with the "LEGAL ANSWERS" as to what can be done by you, and also against you..

As to defending the towing service, I am sorry but in reading the question again, I see no question or answer as to information to provide correct answers for you.
