Towing Issues: Improper towing, jamaica plain ma, cell pic

Question
I lived in Boston and my car was towed yesterday 12/02/07 from a housing complex which I did not have a permission to be park on. However, I heard my car's alarm go off and when I came outside the house, I saw that my car was being towed. At that moment the tow truck was taking a left and I was waving at the guy to stop but he sped on in such manner as if he saw me. Immediately, I jumped into my friend's car and followed the truck(at least tried to because the tow struck was speeding away). As I got closer I noticed that the my car was not being towed in a proper way. The car wasn't straight with the road and the front wheels were not rotating. It seemed as if the car was being drag or pulled instead of rolling and the car's horn alarm was sounding off all the way through. As I watched from a couple of feet away, I could not resist but get furious, to see my car get towed in such way( I should have taken a cell pic but my frustration over what was going on did not let me). When I got to the Companies' lot, (Santana's in JP) I also noticed that they broke in into the car, placed the car in neutral and also pulled the emergency brake,(why?? I don't know). Not only had I to see my car being drag all over Jamaica plain,MA but also pay $110 to get my car out. Boston police was called to Santana's because I was in way irritated and claiming the potential damage on the car, but the police in reality did not justify anything and in reality were only there to protect Santana's employee. The police did not want to file a police report so now I have not proof whatsoever of what happened. This morning my car made a weird noise as I was taking a left turn that I had not heard before, but who to blame? Are tow companies allow to mistreat someone's else property and get away with it, just because there is not concrete proof, and because they have contracts that allow them to? Are tow companies in Boston, MA allow to brake into someone's car, do you see anything odd on the way they towed my car, what is your suggestion about this case?

Answer
well I have to say that this does not sound good for the tow company, or help the general towing image of tow companies..

Now proof or not the option of small claims court is always available...

I would have the vehicle checked out to see what kind of noise and the reason for it is..

The police basically did the correct thing as towing from private property is a civil matter and a lot of time they do standbys at the tow company because as you said you were mad...
Point to remember is that the tow company usually responds to calls for service by the property owner or manager for removing the illegally parked vehicles.  And as you said you parked where you did not have the rights to be parked and while the court may help you recover some of the money they will also take that into the decision making issue.

Paying the $ 110.00, well that is cheap compared to other areas of the  United States.  Sorry that you had to pay.

Hope this helps you a bit with this issue.
