Towing Issues: Had car towed, small claims court, half is better than none

My car, a 1999 rav4 had to be towed, the muffler that was recently repaired (still under warranty) broke and fell to the ground. I called to have it towed back to the shop to have it fixed and the truck came a hour and a half late, i told the man the issue he didn't care, he went to drive the car up onto the flat bed and the pipe caught the lip on the flat and bent. Now i need a new pipe and need to pay to have it put on. they said they will pay for half shouldn't they pay for it all? it would of been a free fix

In a real world it would seem they would pay it all, but it does not seem like they are really trying to get out of a damage claim at least cost...

From what you say here they did damage the vehicle and should be responsible, but in my towing experience I do know that if it was not broke and hanging then they would not of had to be called for the tow...  It does seem to me that the driver from what you say does not really have much care and training on towing vehicles or he just had a really bad day (which does happen)

I would take the half they pay and then get it repaired and then go the small claims court route for the rest of the money.. True you might pay for the repairs yourself and then do the court route, but if you lose for some reason then half is better than none.
