Towing Issues: Vehicle towing, storage yard, tow companies

Question
I have a question.. That I hope you can answer.. Me and my wife went out to a club last Sat., we live in San Antonio Texas, and the parking lot was full.. So we parked along the curb of the parking lot (inside the Parking Lot)..  Vehicles could still travel throughout the parking lot.  Luckily, my friend happen to see the tow truck drive away with my vehicle, he tracked him down, stopped the truck and called me.  We were able to get our vehicle back after $130 bill.  The truck driver stated that there was a sign stating "Do not block driveway".  Obviously, we were upset and contacted the towing company, and asked to define "driveway", all we got from him was vulgarities and disrespect, I couldn't even get a name.  We informed him that I did not park anywhere that prevented vehicles from entering/exiting the parking lot.  Do I have a leg to stand on if I want to take this to court to get my money back?

Answer
well I really hate to say it, but from what you have said here you do not really stand much of a chance in court (these are my personal thoughts) since the judge would ask a few questions..

Where you on private property ?
Did you park in a marked space ?
Do you think parking in an aisle or roadway is ok ?

Unfortunately this is most likely going to be the questions asked and I believe that the judge will rule against you.

If you got the vehicle back for $ 130.00 then you got off light as if it gets to the storage yard then it most likely would of been about $300 to $400 to get back.

Sorry that the tow company was rude and not answering your questions that you asked, but it does get old at times for tow companies who do private tows to explain stuff 4 or 5 times on each vehicle towed.

Hope this helps you.
