Towing Issues: towing damage, minor scratches, question pool

Two days ago the ignition jammed.  The dealership (hired a towing company) came to tow the car.  They pulled the car onto the tow truck in PARK with the tires moving.  After arriving at the dealership, they couldn't get the car off.  The mechanic popped the hood to check it out.  It came out of gear, ran over the mechanic, went down an embankment with the mechanic into a shallow reserve pool.  After calling an ambulance for the mechanic, the car was put back in PARK and pulled up the embankment in park with the tires moving.  Multiple mechanics have reported to me that this had to have destroyed the transmission.  However, the dealership reports that there were only a few minor scratches and a cut fuel line.
My husband witnessed both attempts at towing the car and neither time did the tow driver turn the bolt to release the gear.  When I speak of the tires moving it was not with ease.  They obviously weren't supposed to, but couldn't help but turn due to the force of the vehicle being pulled. What do we do?

Kristi, first of all, I found this in the question pool which I did not know existed. With that said I hope this issue has been resolved..

OK first of all, it sounds like the towing company used a flatbed tow truck to do the tow.. If the ignition was jammed then it would not release the transmission park pawl to allow it to roll. This is a mechanical part, a pin that controls the shifting assembly..  
Now "dragging" the vehicle to many looks bad but it "USUALLY" does not result in damages. But like any mechanical part there can be problems...

There are many methods to get the vehicle to roll, slide or move, but that is not the question here...

I hope the mechanic is ok now (since this was lost in the question pool), but two safety issues come to mind here..
First of all the mechanic checking out the vehicle while it was on the truck is WRONG... Its unsafe to have ANYONE on the bed of the tow truck while its tilted.

Now the second issue is that from the sounds of it, all the safety chains, straps and even the winch cable were unhooked from the vehicle with results as it did... This operator just did not have much of a clue as to safe operation of the unit..

OK, now it does sounds like the mechanic might of caused the vehicle to take off and end up in the pond by releasing the park linkage control pin...

I would be interested in hearing the finally issues of what happened here, as it does sound a bit funny that the vehicle would suddenly start to roll...  But I again highly doubt that the towing company did damage it, but I see they need some more training in how to do the job properly and safely..
