QUESTION: A 2002 cl-500 79,021 miles a V12 serviced it like in july still does the samething. but as i say its just from 1st to second and once the 2nd gear is in it will work perfect all gears will shift normal.

Answer
Frank,
Not sure what V12 is... If the fluid is at the normal level and there is a delay of release from first to second gear, you could have a problem with the governor or electronics.

Some transmissions are independent of the computer, some are not and there is also a relationship between the accelerator pedal position and shift points in some vehicles.
If after the shift changes you have a positive feel and no slippage of the second band then you may be ok, otherwise a failure is probably soon to follow.

Depending on the transmission service intervals and type of fluid used. Must use Mercedes fluid. I have heard of new fluids causing shifting problems. It there was a long period before the change, then there is particulate that coats the surfaces. When the new fluid is added, it washes off these particles that help seal some of the O rings etc, and bad shifting and slippage are the result.
I suggest you locate an independent transmission service that know about Mercedes transmission and have them test drive the vehicle.
Good Luck
