Tips on Buying Cars: New car w/ cracked frame, saturn vue greenline, saturn vue

Question
Hi-- I am hoping you can help me to figure out what I should do here...I
recently purchased a new Saturn Vue greenline hybrid, and 2 days later
noticed water leaking into the back of the hatch and collecting inside--I took
it to the dealership for examination and they found a 4 inch crack in the car;s
frame and rust from that crack leaking down into the car.  They have a 30 day
exchange policy so I told them to find a vehicle to trade it out and they said
w/in a 1500 mile radius there is not another vehicle like it, so their best offer
is to weld the frame and warranty the repair for 5 measly years (rust could be
a problem long after that, right?) not to mention other cracks could be
present since it is a manufacturing defect.  I feel that if they cannot find a
replacement that they should give me my money back, but they have not
offered that....I can't really be expected to keep a new car w/ a cracked frame
right?  I will never be able to re-sell ii. right?  I feel like I am stuck and wonder
if I should contact a lawyer?  what do you think?

thank you so much for all your help...

Kate

Answer
Hi Kate
You may have to contact a lawyer, from reading your question it bring up a lot unanswered questions.

1... A Mfg defect ?, if thats the case then Mfg should be notified.
2... Did you ever see a history report on vehicle like CARFAX ? to ensure vehicle has never had a reported accident, if vehicle had a reported accident then in most cases its mandatory selling dealer include accident repair written on bill of sale for you to sign.
3... What does the title say ?, rebuild ? salvage ? I am guessing not since you have an exchange policy.

Tell seller of your intentions, you want a refund or you will contact a lawyer along with the BBB and the ministry of transport for your area
Good Luck
