Tips on Buying Cars: New car purchase, buyers remorse law, new car purchase

Question
I bought a brand new Nissan Quest  24 hrs ago and the salesman I bought it from, I have purchased two cars from him before , so I trusted him to get the best deal. The "good faith" $100  was put in place to get the deal rolling, and was promised to be returned at the time Of signing, but it was not. The extended warranty on my trade in was supposed to come back to me--(the difference in what I paid in) so far nothing.  but all the papers were signed,  The salesman is telling me, that if I didn't get the $100.00 back at Finance  when we signed all the papers, that the it is gone, and the only way to get it back now would be to cancel the deal and re-sign everything.  He has also told me that as far the cash back on the extended warranty, he is looking into it and it will get done--but that it could take a couple of weeks  before  it is completed---Keep in mind, we bought the trade in from the same person at the same dealership 3 years earlier...Is there a buyers remorse law concerning new automobiles?   I looked up the warranty myself, called the warranty company, who had my information on their screen in seconds, and then they informed me that the dealer keeps all copies of the extended warranty contracts--all they do is issue service cards....
I can find no mention of the $100 good faith on any of my paperwork, but it did come out of my bank account?!  My salesperson seems to be giving me the run around since the papers have all now been signed.......Any help would be great.  I am in Upstate NY.
Thank-you,
Al

Answer
Al,

It sounds like you got taken, which is unfortunately not very uncommon.  Here's the deal.  They owe you the $100 period.  It doesn't matter if it wasn't given to you in finance or not.  If you paid them $100 and it isn't on your contract as a down payment, then they owe you the $100.  The warranty deal is a little confusing.  They could have used it as down payment towards the purchase of the new Quest.  If they did not, it does take several weeks to get the refund of extended warranties, because the dealership isn't the only company involved.

My recommendation is this.  Quit dealing with the salesperson and call to speak to the General Manager of the Dealership.  The salesperson has absolutely no power in this situation.  You need to speak to the General Manager and let the GM help you.  If you don't get anywhere with the GM, then call Nissan Customer Service and file a complaint, and they will force the dealership to take corrective action.

As for a Buyer's Remorse law.  No, there is not a cooling off period in New York.  You are stuck with the deal, but you are not stuck without your $100 or your warranty cancellations.

Please let me know how this all works out.

Thanks - jb
