Tips on Buying Cars: Returning car, trophy nissan, gas guzzler

Question
I just bought a used car yesterday from trophy Nissan. I told the salesman that American cars were not for me. He ended up taking me around and letting me look at a few cards and said he would see what he could do. He came back and said that a dodge magnum was the only car I could have gotten. I ended up paying 18,000 for a 2007. I took it home only to realize that it was a gas guzzler and way to big for me to try and park. I then went on the website to look at all the cars they had on the lot and saw mine which was priced at 16,000. I feel like I was srewed out of 2,000 and pressured into buying a car I don't really want. I went up there to talk to the sales guy at which time he told me the sale was final and a finance company had already approved my loan. I called back in later to find out who my finance company was at which time they refused to transfer me to a sales manager and said they didn't know. So I went back up there and asked for a sales manager. I spoke with the sales manager who told me that my application is in the process of being shopped around to different finance companies. So I asked him if it's not final why couldn't they get me into a different car. One I'm more comfortable with. He said he would look at my paper work and see what he could do but I seriously doubt he's gonna do anything except tell me he couldn't after not looking at my paper work. I also asked him why I did not receive a copy of my sales contract. He replied that I would not receive one until the finance company approves the deal. I also told him if the terms of the contract that I signed were not approved that I would not be signing another one. My question is, is there anyway to get out of buying this car? I could not look in my contract to see if there was a cooling off period considering they wouldn't give me a copy.

Answer
Jamie,

Well you are kind of in a pickle here.  First there is not a cooling off period in the state of Texas.  I work less than 30 miles from Trophy Nissan, and this is very typical of that store and the ownership of that store.  THE ONLY THING you have going for you is that they are REQUIRED by federal law to give you a copy of the contract at the time that you buy the vehicle.  They have broken a federal law by not doing this.  A lot of stores do it, but it is against the law.  You need to go back up there and let them know that they have broken a federal law.  It even says that on the contract that you signed.  That is the only thing that you have them on right now.  You signed the contract and there is not a cooling off period in the state of Texas.  Unfortunately it seems that they took advantage of you because they knew that you did not know what is right and what is wrong.  Let me know how it turns out.

Thanks - jb
