Used Cars: buying and breakin, three payments, hi mary

Question
My son bought a truck with three payments. But when he drove it about 8 miles after picking it up. He went to go into town and made it 3 houses down.  The transmission quit. He then called the person that he bought it from, only to learn that they had been driving the truck after he had already put money down on it. They were driving it, knowing that he had insurance on it, and he did not give them any permission to drive it.  My question is: When you put money down on a truck to the owner. Doesn't that mean that it they would no longer be able to drive it?  He was told that it was parked behind the house, then tonight he learned that they have been driving it.  Can or should he get his money back? and or Should they have to pay to fix it? Thank you for your time.  Please respond ASAP

Answer
Hi Mary Ann

I agree with what your saying but the sad truth is when you buy a car privately you got no recourse, whatever problems the car may have becomes your problems once you have taken delivery.

Had you purchased from a dealer you would have gotten a bill of sale stating current miles, and would have had a case for refund if miles were much higher upon delivery.
