Auto Insurance Claims: How I should proceed to get a Letter of Evaluation (L.O.E.) from my Insurance Company to clear my driving record to be treated at NO fault?, pontiac drivers, pontiac grand prix


Question
On December 2007, my Honda Civic was struck by a Pontiac Grand Prix, in a quite busy intersection (2 lines both ways both roads) with traffic lights. The Pontiac was speeding on red light and after the collision forced my car to spin once being turn in the opposite direction of traffic; The Pontiac front end hit my passenger’s side rear wheel, rear right fender, and rear bumper and causing $3,500 in property damage, and not to big visible damage to the Pontiac other than few scratches at the front bumper which also was showing a bit bent (but their car was fully functional, my needed to be towed from the intersection).
Because I was too shocked by the accident, I couldn’t think clear what I have to do immediately so I didn’t stop any witness at the site, but after 45 minutes from the accident when the police finally arrived I found a witness at the gas station which is located at the corner of the intersection. The gas station worker said that she saw the accident and that the Pontiac was speeding on the red light but she is not going to testify or gave me any statement. Also, the police officer spoke with her.
Even though the police officer have said at that time that he believes that this was the Pontiac driver’s fault the final accident report doesn’t state anything about who is at fault and no charges were laid. I tried at that time to clear this up and to prove that the Pontiac driver’s is at fault but I could do anything. I have left several messages with the police officer but he never answered back.

Both cars were insured by the same insurance company and even if I tried to sort this out and asked my insurance agent to speak with the police officer and not to be charged at fault, at the end the case was settled at 50% fault.
As a result my insurance policy went up and now after three years looking for another insurance company to renew my auto insurance I am getting bad quote prices because I am treated as at fault for accident.
I think this is not fair and I was advised by an insurance agent to ask for a Letter of Evaluation (L.O.E.) from my insurance company with which I would be able to clear my record.
So my question is how I should proceed to get that Letter of Evaluation (L.O.E.) from my Insurance Company to clear my driving record?
I am from Ontario, Canada, and my insurance company is from US.

Hi Hanriett,

Unfortunately, I am located in the US and am not familiar with the way things work in Canada. I have never heard of a L.O.E. I do not think the insurance company will give you one anyway.

If it works anything like in the US, this accident wqill only count against you for 3 years. You only have 5 months to go before it drops off your driving record. I think you would be better off to just pay a little higher premium or stay where you are and then change insurance after the 1st of the year.
